The applications seeks restoration of C.W.J.C. No. 4044 of 2010 which was dismissed for non-prosecution on 19.11.2013 noticing as under:- "Despite repeated calls, nobody has appeared on behalf of the petitioner to press this application.
Counsel for the University is present.
Learned counsel for the University states that the issue relates to a college which was taken over in the fourth phase.
The matter is now pending before a Commission headed by a retired Judge of the Supreme Court. The petitioner, if aggrieved, may approach the said Commission for resolution of the disputes.
Patna High Court MJC No.3244 of 2015 (2) dt.27-01-2016 2/2 Since nobody has appeared on behalf of the petitioner to press this application, this Court is constrained to dismiss the application for non prosecution. I order accordingly."
Nearly two years thereafter the present application has been filed for restoration. Upon perusal of the statements made therein and after hearing counsel for the petitioner, this court does not find good ground for restoration of the application.
