Petitioner is languishing in judicial custody since 30.09.2016 in connection with C-107(7) of 2016 registered for the offence punishable under Sections 47(a) of Bihar Excise (Amendment) Act, 2016.
The prosecution case as alleged by the police personnel is that on receiving secret information they caught the petitioner who was fleeing away and in her possession 1.400 liter Chulhai wine was recovered. Accordingly, a seizure list was prepared. It has been submitted by learned counsel for the petitioner that she is innocent and has no criminal history and has falsely been implicated in the present case.
However, learned A.P.P. for the State submits that
Patna High Court Cr.Misc. No.54634 of 2016 (2) dt.23-12-2016 petitioner is named in the FIR hence, opposes the prayer for bail. Be that as it may, considering the facts and circumstances of the case and submission of the parties, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with C-107(7) of 2016 under Murliganj Police Station.
