JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2018 The petitioner seeks bail in connection with Govindganj (Areraj) P.S.Case No. 248 of 2018 registered under Sections 302 and 328/34 of the Indian penal Code.

Allegation against the petitioner and other accused persons is of administering poison to the wife of the informant causing her death.

Submission of learned counsel for the petitioner is that as a matter of fact there was love affair between the wife of the informant and the one Dhun Tiwari and both taken poison due to which, wife of the informant died, however, co-accused Dhun Tiwari was saved and this fact is disclosed by the informant and Puja Kumar stating that they did not take the deceased to any medical hospital or any doctor rather she was treated by some

Patna High Court Cr.Misc. No.74852 of 2018(2) dt.20-12-2018 2/2 Ayurvedic doctor and during treatment she died and petitioner is in custody since 27.08.2018.

Heard learned APP and learned counsel for the informant, who has opposed the prayer of bail stating that petitioner is threatening the witness also.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, East Champaran, Motihari in connection with Govindganj (Areraj) P.S. Case No. 248 of 2018 with condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
