ANJANA MISHRA ORAL ORDER 19-11-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is in custody since 09.06.2016 in connection with Raxaul P.S. Case No. 88 of 2016 registered for the offences punishable under Sections 147, 148, 149, 323, 324, 354, 363, 448 and 307 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that he is not named in the F.I.R but he has been taken into custody on suspicion and he was also named in another case which was filed under the Arms Act in connection with the same occurrence. Learned counsel for the petitioner further submits that in other case being Raxaul P.S. Case No. 89 of 2016, the petitioner has

Patna High Court Cr.Misc. No.40787 of 2016 (3) dt.19-11-2016 2/2 already been granted bail vide order dated 07.09.2016 passed in Cr. Misc. No. 37306 of 2016. The petitioner has brought on record another order dated 27.09.2016 passed in Cr. Misc. No.40123 of 2016 in which similarly situated other co-accused persons have been extended regular bail in connection with the present case. It is submitted that the petitioner also stands similarly placed. In view of the aforementioned facts and circumstances and the nature of allegations and also that no one was injured in the incident so alleged, let the above named petitioner, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Raxaul at Motihari in connection with Raxaul P.S. Case No.88 of 2016. (Anjana Mishra, J.) ravi/- U T
