I have perused the materials on record and after hearing learned counsel for the petitioner and learned counsel for the state, I am not inclined to grant anticipatory bail to this petitioner, and prayer for anticipatory bail is accordingly rejected. However, in the facts and circumstances of the case, if the petitioner surrender and prays for bail, the court below shall consider the same without being prejudiced by the present order.
