This is an application for grant of anticipatory bail in connection with Sheosagar PS case no. 259 of 2016 registered for the offences punishable under Sections 147, 148, 149, 153(A), 295, 295(A), 353, 427, 505(C) of Indian Penal Code. The allegation leveled against the petitioner and others is with regard to taking out procession through a lane where, police had restricted them. It has been further alleged that on account of communal tension, some altercation took place between the accused persons and the local administration. Patna High Court Cr.Misc. No.23305 of 2017 (3) dt.13-06-2017 2/2 supplementary affidavit today annexing the orders passed by this Hon'ble Court on 18.03.2017 and 08.04.2017 passed in Cr.Misc. no. 6644 of 2017 and Cr.Misc. no. 17433 of 2017 respectively wherein, similarly situated co-accused persons have already been granted bail.
Having regard to the facts and circumstances of the case as also the fact that similarly situated co-accused persons have already been granted bail vide order aforesaid, I deem it fit and proper to grant anticipatory bail to the petitioner. Accordingly, abovenamed petitioner is directed to be released on anticipatory bail on furnishing bonds of Rs. 20,000/- (Rs. Twenty thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sasaram at Rohtas in Sheosagar PS case no. 259 of 2016 subject to the conditions enumerated under Section 438(2) of Code of Criminal Procedure.
