The petitioner seeks regular bail in connection with Kusheshwar Asthan P.S. Case No. 199 of 2020 instituted for the offences under Sections 341, 323, 307, 354B, 379, 504, 506 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 19.10.2020 and charge-sheet has been submitted in the case.

Learned counsel for the petitioner submits that from bare perusal of the allegation as alleged in the F.I.R. it would manifest that the informant alleges that all the accused persons named in the F.I.R. assaulted her son.

No.33861 of 2021(2) dt.30-11-2021 2/2 Learned counsel for the petitioner submits that specific allegation is against Bechan Paswan of assaulting by iron rod and as far as the petitioner is concerned, nothing specific has been alleged, rather the allegations are general and omnibus in nature.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 19.10.2020 and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IV, Benipur, Darbhanga in connection with Kusheshwar Asthan P.S. Case No. 199 of 2020 subject to the condition as laid down under Section 437 (3) Cr.P.C.
