JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 25-01-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.
The petitioner seeks bail in a case for the offences punishable under sections 30(a), 32(i) and 38(i) of the Bihar Excise Amendment Act.
Allegedly 18 litres of foreign liquor was recovered from the plastic bag of the petitioner which was thrown away in the bushes. Submission is of false implication and that nothing has been recovered from the conscious possession of the petitioner. He has been made victim of the circumstances. Admittedly other miscreants succeeded in fleeing away.
Learned APP appearing for the State opposes the prayer of bail.

No.2140 of 2017 (2) dt.25-01-2017 2/2 In the facts and circumstances as stated above and considering the detention of the petitioner, he is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M., Lakhisarai in Excise Case No. 166C2 of 2016, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
