JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-01-2019 The petitioners apprehend their arrest in connection with Jalalgarh P.S.Case No. 115 of 2018 registered under Sections 120B, 201, 302, 363, 365 and 370/34 of the Indian penal Code. Allegation as per the FIR is that two ladies were found missing from their house while going to market and later on their dead bodies were found and petitioners are not named in the FIR.

Submission of learned counsel for the petitioners is that on the confession of one Birendra Singh, name of the petitioners and other co-accused Parmanand Yadav were transpired though Parmanand Yadav has been granted privilege of anticipatory bail by a co-ordinate Bench of this Court vide order dated 02.011.2018 passed in Cr. Misc. No. 59175 of 2018 and except confessional statement, there is nothing against the petitioners.

Patna High Court Cr.Misc. No.1132 of 2019(2) dt.17-01-2019 2/2 Heard learned APP also who has opposed the prayer of bail on the ground that on the basis of confessional statement, two heads were recovered.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioners, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Purnea in connection with Jalalgarh P.S. Case No. 115 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure with a further condition that they will to co-operate in investigation.
