The petitioner seeks bail in a case instituted for the offences under Section 379 of the Indian Penal Code. The prosecution case in short is that the accused persons picked up the purse of the informant at the Railway station.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 16.2.2019. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner is not named in the F.I.R.. The petitioner has been made accused due to mistake of fact. The recovered mobile has not been put on T.I.P. It is further

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R..

Considering the aforesaid facts and circumstances, on completion of six months in custody, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Railway, Barauni, Begusarai in connection with Rail Barauni P.S. Case No. 190/18.
