KUMAR ORAL ORDER 09-01-2018 Heard learned counsel for the petitioner and learned counsel for the Bihar State Electricity Board. The petitioner was appointed as Security Cook. After two months, proceeding was initiated against him regarding misbehaviors and misconduct towards the other security personnel and dereliction in duty and Enquiry Officer was appointed for investigation and the charges leveled against the petitioner were found true as framed against him and considering the same his contractual appointment was terminated.
Patna High Court CWJC No.3971 of 2013 (4) dt.09-01-2018 2/2 In view of the facts and circumstances and appointment being contractual and in terms and conditions of appointment, his services were terminated, as such same needs no interference. It has been further submitted that he is entitled for his salary for working period but he has been paid only one month salary and the authority may consider the payment of rest of amount. The petitioner may file a representation before the concern authority giving details of his due salary and if same is found to be payable he be paid all his remaining salary within three months from receipt/production of a copy of this order. With this observation, the present writ petition is disposed of.
