The petitioner is accused in connection with Naugachia P.S. Case No. 83 of 2016, registered under Sections 306, 498A, 201, 120B/34 of the Indian Penal Code The accusation is that Suraj Kumar Sah received information to his brother-in-law (Petitioner) regarding committing of suicide of his sister due to torture made by cousin father-in-law, cousin mother-in-law and their two children. When the informant reached at the house of his sister Laxmi Devi then he found that her dead body was hanging. Learned counsel for the petitioner submits that it would appear from the F.I.R. that the marriage of the petitioner was performed with the sister of the informant before six years
Patna High Court Cr.Misc. No.164 of 2017 (2) dt.11-01-2017 2/2 and there was two children out of their wedlock and there is no allegation of torture by this petitioner to the deceased, sister of the informant. Further submission is that, in fact, petitioner has been implicated in this case in course of investigation only being the husband of the deceased. The petitioner has no criminal antecedent and he is in custody since 27.05.2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Naugachia, Bhagalpur in connection with Naugachia P.S. Case No. 83 of 2016.
