====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 15-01-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Yogapatti P.S. Case No. 328 of 2018, instituted for the offence under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act. In the written report there is specific allegation of causing firearm injury to the nephew of the informant against Vijay Yadav.

Post mortem report has been enclosed as Annexure-2 which shows that only one firearm injury has been found on the abdomen of the deceased. Petitioner is named in the written report on the ground that he was found running away from the place of occurrence.

Considering the aforesaid facts and circumstances of

Patna High Court Cr.Misc. No.77572 of 2018(2) dt.15-01-2019 2/2 the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, Distt. West Champaran, in connection with Yogapatti P.S. Case No. 328 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
