JUSTICE SUDHIR SINGH ORAL ORDER 29-08-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 364 and 302/34 of the Indian Penal Code. Prosecution case is that in the night on hearing sound of fire arms informant and his elder son went to see what had happened. They saw that the accused persons kidnapped informant's son, namely, Upendra Yadav and later on his dead body was recovered.
It has been submitted on behalf of the petitioner that he is in custody since 12.4.2016. Chargesheet has been submitted against the petitioner. No allegation of tampering of witnesses is alleged against the petitioner. Altogether six persons are alleged to have abducted the victim. The said persons are named in the F.I.R. Petitioner is not named in the F.I.R. In course of investigation, it has come that daughter of the petitioner had illicit relation with the deceased and for the said reason he has been made accused in the present case.
On behalf of the State, it is submitted that petitioner is not named in the F.I.R.

No.26931 of 2016 (3) dt.29-08-2016 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Jamui, in connection with Chandradeep P.S. Case no. 58 of 2010.
