Sri Murlidhar ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY KUMAR ORAL ORDER 17-12-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners apprehend arrest in connection with Lalganj P.S Case No. 289 of 2018 registered for offences punishable under sections 147, 148, 149, 341, 323, 353, 427, 504/34 of the Indian Penal Code.

The informant of this case happens to be Police Officer. It is alleged that these petitioners along with others obstructed trafficking by blocking National Highway. On

Patna High Court Cr.Misc. No.75401 of 2018(2) dt.17-12-2018 2/3 interrogation, they raised protest and assaulted him. It has been submitted that the full brother of petitioner no.3 was murdered for which a police case, vide Lalganj P.S. Case No.288 of 2018, was registered against one F.I.R. named person under sections 302/120B of the Indian Penal Code. Some of the villagers in order to protest the police inactiveness raised slogans. The petitioners being family members have been implicated in the present case. The allegation of causing hindrance to police administration is omnibus. The petitioners have clean antecedent.

Considering the nature of allegation, facts and circumstances of the case, the prayer for anticipatory bail of the petitioners is allowed and they, in the event of arrest or surrender before the court below within six weeks from today, are directed to be enlarged on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali (Hajipur) in connection with Lalganj P.S Case No. 289 of 2018, subject to the conditions as laid down under section 438 Cr.
