JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 26-08-2022 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner apprehends his arrest in Ahiyapur P.S. Case No. 135 of 2020, registered for the offence punishable under Sections 272, 273 and 34 of the Indian Penal Code and section 30(a)/36 of the Bihar Prohibition and Excise Act. 394.875 litres of foreign liquor has been recovered from vehicle of this petitioner.

It is submitted that petitioner has falsely been implicated in this case. Nothing has been recovered from conscious possession of this petitioner. Vehicle in question has already been transferred to Kundan Kumar.

Counsel for the State vehemently opposed the bail application and submitted that recovery has been made from the

Patna High Court CR. MISC. No.23837 of 2022(3) dt.26-08-2022 2/2 vehicle of which this petitioner is registered owner. Considering the fact that petitioner has not annexed the transfer certificate, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
