NILU AGRAWAL ORAL ORDER 14-10-2015 Heard learned counsel for the petitioners Mr. Bhaskar Shankar and learned A.P.P. for the State.

The petitioners apprehend their arrest in Madanpur P.S.Case No. 47/2012 for alleged offences under Sections 307, 147, 149, 341, 323 of The Indian Penal Code.

The prosecution case is that on 5.03.2012 at about 12'o clock at day time, the informant had come to Madanpur from his village Mahuawan to purchase some goods and after purchasing the goods, he was returning to his house along with one Amarjit Kumar at about 3.00 P.M. As soon as they reached near Ghorhar Mor Ara machine, the accused persons namely, Raju Kumar, Prem Kumar and three others armed with ari restrained him and assaulted on his head causing head injury. It was alleged that petitioners along with the named accused assaulted on the head of the informant by ari used in cutting wood at Ara machine. It has been submitted by the learned counsel for the petitioners that they are innocent and have been falsely implicated due to enmity. It has further been stated in para-3 of the petition that the petitioners have clean antecedent and the injury has been found to be simple as is evident from the injury report, which finds place at Annexure-2 of this petition.

Under such circumstances, let the petitioners, above named, in the event of their arrest or surrender within a period of six weeks from today, before the Court below, be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Madanpur P.S.Case No. 47/2012, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
