Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner has preferred this application for grant of regular bail in connection with G.R. No. 2217/2021 arising out of Jaynagar P.S. Case No. 320 of 2021 dated 21.11.2021 registered for the offences punishable u/s 30(a) of the Bihar Prohibition and Excise Act.

As per the prosecution case, the police got information that co-accused Pramod Chaudhary and the petitioner had stored country-made liquor in their houses. On

Patna High Court CR. MISC. No.31347 of 2023(2) dt.22-05-2023 2/3 raid, the petitioner and the co-accused Pramod Chaudhary fled away whereas the wife of Pramod Chaudhar, Lalita Devi was apprehended. On search, 585 litres of country made liquor and 59.46 litres of foreign liquor were recovered. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The other co-accused person has already been granted bail by the Co-ordinate Bench of this Court vide order dated 31.05.2022 passed in Cr. Misc. No. 466 of 2022. The petitioner is accused in one more criminal case as stated in para 3 of the bail petition. The petitioner is in custody since 10.02.2023.

Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Madhubani in connection with G.R. No. 2217/2021 arising out of Jaynagar P.S. Case No. 320 of 2021.
