JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 20-04-2015 Heard learned counsel for the petitioner as well as learned A.P.P. for the State.
It has been alleged against the petitioner to have shot and causing injury over the person of informant when, the informant resisted selling of spurious wine from a stall belonging to the petitioner, installed in the land of the informant. The contention on behalf of the petitioner is that he has been falsely roped in the background of the fact that with regard to the land under reference, a proceeding under Section 144 Cr.P.C. as well as a mutation appeal is pending since before. It has also been submitted that land happens to be under his exclusive possession. The petitioner has also constructed a temple over the land under dispute. It has also been submitted that the
Patna High Court Cr.Misc. No.47922 of 2014 (2) dt.20-04-2015 2/2 informant might have sustained injuries at some other place in some other manner but, on account of persisting animosity amongst the parties, petitioner has been roped. The learned A.P.P. opposes the prayer.
From the order impugned, it is evident that informant had sustained fire-arm injuries over his person and for that petitioner is found responsible therefor. Accordingly, the anticipatory bail petition is rejected.
