JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-01-2019 The petitioner apprehends his arrest in connection with Sitamarhi P.S.Case No. 440 of 2018 registered under Sections 457 and 480 of the Indian penal Code.

Allegation is of committing theft in the house of the informant and petitioner and one co-accused have been named in the FIR on the basis of suspicion.

Submission of learned counsel for the petitioner is that as a matter of fact on the date of occurrence, petitioner was at Varanasi to appear in an examination and he has produced the paper with respect to same but that has not been accepted by the court below and petitioner has no criminal antecedent. Heard learned APP also.

Having heard both sides and in the facts and

Patna High Court Cr.Misc. No.77979 of 2018(2) dt.04-01-2019 2/2 circumstances, as stated above, let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Sitamarhi in connection with Sitamarhi P.S. Case No. 440 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
