The petitioner apprehends his arrest in a case registered for the offence punishable under Section 30(a)(c)(d) of the Bihar Prohibition and Excise Act, 2016. 10 litres of country made liquor has been recovered from open field near Dalan of the petitioner. It is submitted that nothing has been recovered from conscious possession of this petitioner. Recovery has been made from open place which is accessible to general public. Petitioner has been made accused in this case only on suspicion. Petitioner claims clean antecedents.

Considering the facts aforesaid, the petitioner abovenamed in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production

Patna High Court CR. MISC. No.23550 of 2023(2) dt.26-06-2023 2/2 of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No. 2-cum-Additional District & Sessions Judge, Rohtas at Sasaram in connection with Sanjhauli P.S. Case No. 204 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
