Mr.Suman Kumari Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 23-05-2023 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Banka P.S. Case No. 540 of 2021 for the offence under Sections 341, 323, 504, 506, 34 of the Indian Penal Code and later on under Section 302 of the Indian Penal Code has been added. Learned counsel for the petitioner submits that the petitioner has got one criminal antecedent and he is in custody since 04.11.2022.

Prosecution case, in brief is that petitioner along with accused persons started to assault the informant and also threatened to kill the informant.

The deceased died after a month of the incident and charge-sheet has been submitted by the

Patna High Court CR. MISC. No.25942 of 2023(2) dt.23-05-2023 2/2 police under Section 304 of the Indian Penal Code though learned Magistrate has taken cognizance against the petitioner under Section 302 of the Indian Penal Code.

Considering the fact that the petitioner has got one criminal antecedent and period of custody, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-I, Banka in connection with Banka P.S. Case No. 540 of 2021.
