JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code.
Petitioner happens to be mother in law of the deceased. The marriage of deceased had taken place with coaccused, Lal Babu Ram twelve years back and in course of investigation, almost all the co-villagers of the petitioner stated that co-accused, Lal Babu Ram used to quarrel with the deceased. The dead body of the deceased could not be recovered. The investigation against the petitioner has already been completed
Patna High Court Cr.Misc. No.46508 of 2016 (4) dt.06-12-2016 2/2 and after perusal of the case diary I find that except suspicion, there appears to be nothing against the petitioner. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-IX, Motihari in connection with Kalyanpur P.S. Case No. 113 of 2016.
