Learned counsel appearing on behalf of the petitioner submits that respondents have taken policy decision for posting of the petitioner in the event of promotion as Headmaster in the same school if post is available.

Learned counsel submits that petitioner is entitled to posting in the same school on promotion. He further submits that the respondents were required to consider the option exercised by the petitioner in terms of their own policy decision. Learned counsel for the petitioner submits that

Patna High Court CWJC No.8027 of 2019(3) dt.01-07-2019 2/2 vacancy in the school in question is available yet the respondents have not considered posting of the petitioner in accordance with their policy decision.

Considering the aforesaid, the writ petition is disposed of with direction to the respondents to follow the guideline issued by the Director, Primary Education in the matter of posting on promotion.

Necessary decision for posting of the petitioner in accordance with the guideline may be taken by the respondents at the earliest preferably within a period of sixty days from the date of receipt/production of a copy of this order. With the aforesaid, the writ petition stands disposed of.
