Petitioner apprehends arrest in Triveniganj Police Station Case No 140 of 2016 registered for the offences punishable under Section 7 of the Essential Commodities Act. Counsel for the petitioner submits that from perusal of the first information report, it would be apparent that the petitioner was not at the spot where the truck was seized. Further, from the FIR, he submits that it is apparent that even the driver has not named him. It is further submitted that, admittedly, the petitioner is owner of the vehicle and only because of the aforesaid fact, he has been named in the FIR.

In the aforesaid facts and circumstances, in the event

Patna High Court Cr.Misc. No.24267 of 2017 (2) dt.30-05-2017 2/2 of his arrest or surrender within four weeks from today, the petitioner above named shall be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Supaul in connection with Triveniganj PS Case No 140 of 2016 subject to all conditions as laid down in Section 438

(2) of Criminal Procedure Code.
