Petitioners apprehend their arrest in a case registered for the offence punishable under Section 30 (a) of the Bihar Prohibition & Excise Act.

As per the prosecution case, 7.5 liters of foreign liquor has been recovered from a bush near community hall. Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in the case. No incriminating article has been recovered from the conscious possession of the petitioners and they are no way concerned with the alleged recovery.

Patna High Court CR. MISC. No.23854 of 2022(2) dt.29-07-2022 2/2 Learned counsel appearing for the State opposes the prayer for anticipatory bail and submits that petitioners have got criminal antecedent of similar nature.

Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) BKS/- U T
