JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-10-2016 Heard learned counsels for the petitioner and the State. The petitioner being husband of the complainant is languishing in custody since 6.9.2916 in a complaint case in which process has been directed to be issued after cognizance being taken under Sections 323 and 498A of the Indian Penal Code and sections 3 and 4 of Dowry Prohibition Act.

The basic accusation is of torture for non fulfillment of dowry demands of rupees fifty thousand cash and motorcycle. it is also alleged that the accused persons driven out the complainant from her matrimonial house after snatching her belongings. It is submitted by the learned counsel for the petitioner that the petitioner admits his marriage with the complainant and the petitioner is ready to keep the complainant as wife with full dignity and honour. Statement to that effect has been made in

Patna High Court Cr.Misc. No.47558 of 2016 (2) dt.28-10-2016 2/2 paragraph 15 of the petition which reads as follows: " That it is humbly submitted that petitioner is ready to keep the complainant (O.P. No.-2) as his wife with full love affection and dignity."

Considering the nature of accusation, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Jamui in connection with Complaint Case No. 157C of 2016.
