2. The petitioner seeks bail in a case registered for the offence punishable under Sections-303(2), 316, 318, 317, 338, 336, 3(5)(2) of the Bharatiya Nyaya Sanhita, 2023 (B.N.S.).

3. As per prosecution case, 300 bags of IFFCO APS and 350 bags of IFFCO DAP fertilizer are said to have been stolen away from the truck.

4. It has been submitted on behalf of the petitioner that the co-accused, Shiv Kumar from whose godown, the fertilizer was recovered, has been granted bail by a coordinate bench of this court whereas the co-accused Ganaur Rai who instructed the petitioner to take away the truck, has also been

Patna High Court CR. MISC. No.23814 of 2025(3) dt.06-08-2025 2/2 granted bail. The petitioner is under custody since 19-12-2024 having no criminal antecedent of similar nature.

5. On the otherhand, Mr. Shailendra Kumar, learned APP has opposed the prayer for bail.

Considering the aforesaid facts and circumstances, specially, the period of incarceration, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Sarai P.S. Case No. 280 of 2024 with condition that the petitioner shall cooperate with the trial of the case and make himself available as and when required by the court.

7. Before accepting the bail bonds, the criminal antecedent of the petitioner shall be verified and if, it is found that he is involved in any other case except the case(s), mentioned in paragraph-3 of the bail petition, his bail bonds shall not be accepted.
