JUSTICE VIKASH JAIN ORAL ORDER 30-06-2020 Heard learned counsel for the petitioners and learned APP for the State through video conference. Learned counsel for the petitioners undertakes that all defects pointed out by the Stamp Reporter shall be removed, and compliance with the conditions of the notices of this Court with regard to acceptance of e-filing shall be made, without delay immediately after the lockdown ends, and in any event within one month thereof.

2. The petitioners apprehend their arrest for the offences alleged under Sections 498(A)/34 of the Indian Penal Code and Section 3 and 4 of the D.P. Act registered in connection

Patna High Court CR. MISC. No.21192 of 2020(2) dt.30-06-2020 2/2 with Banka (Mahila) P.S. Case No. 04 of 2020.

It is submitted that the petitioners have been falsely implicated merely because they happen to be various in-laws of the informant, some of whom are ladies and include her married nanads (petitioner nos. 3 and 6). It is submitted that the accusations are general and omnibus in nature and as a matter of fact it is a case of dispute between the husband and wife. The FIR has been lodged belatedly on 07.02.2020 after the informant is said to have been ousted on 27.11.2019 from her matrimonial home. The petitioners claim clean antecedents.

4. Learned APP appears and has been heard.

Be that as it may, in the event of the petitioners' arrest or surrender before the court below within six weeks from the date of communication of this order, let the above named petitioners be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of like amount each to the satisfaction of learned SDJM Banka, in connection with Banka (Mahila) P.S. Case No. 04 of 2020 subject to the conditions as laid down under Section 438 (2) Cr.P.C. if they are not otherwise required in any other case.

6. Office shall ensure that all defects have been removed and compliance with the notices of this Court has been made, within the stipulated time as provided in para 1 hereinabove. (Vikash Jain, J) Chandran/- U T
