This application for regular bail arises out of Kashichak P.S. Case No. 158 of 2019, disclosing offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.
There are six persons named in the FIR including this petitioner. Allegedly, from a Xylo vehicle, huge quantity of illicit liquor and spirit (520 litres) was recovered. The driver of the vehicle and other occupants were arrested. It is alleged that two persons, including this petitioner, managed to flee away. Learned counsel for the petitioner has submitted that Vikash Kumar, the driver of the vehicle, has been allowed regular bail by this Court by order dated 04.12.2019, passed in
Patna High Court CR. MISC. No.21372 of 2020(2) dt.01-07-2020 2/2 Cr. Misc. No. 79026 of 2019. The petitioner is in custody since 13.03.2020.
Considering the above submission, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned 2nd Additional Sessions Judge-cum- Special Judge, Excise, Nawada, in Kashichak P.S.
