JUSTICE SUDHIR SINGH ORAL ORDER 21-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 341, 323, 324, 307, 380, 457 and 504/34 of the Indian Penal Code.

Allegation against the petitioner is of committing theft in the house of the informant, hitting her head with iron rod and also taking away golden chain and ear ring of her. It has been submitted on behalf of the petitioner that he has got no criminal antecedent. The petitioner and the informant are Gotias. The alleged occurrence had taken place due to land dispute between the parties.

On behalf of the State, it is submitted that there is specific allegation of overt act against the petitioner. Considering the submissions made above, I am not inclined to grant anticipatory bail to the petitioner and the same is rejected.

Any how if the petitioner surrenders in the court below

Patna High Court Cr.Misc. No.23197 of 2015 (3) dt.21-09-2015 2 / 2 within a period of four weeks from today and files a petition for regular bail, the same shall be considered and disposed of on the same day on its own merit without being prejudiced by this order. (Sudhir Singh, J) sudip/- U T
