Petitioners apprehend arrest in a case registered for offence under sections 307 and other allied section of the Indian Penal Code.

It is submitted on behalf of the petitioners that the petitioners have been implicated in this case falsely due to previous enmity which is obvious from the fact that though the occurrence has taken place on 19.7.2016 complaint was lodged on 26.7.2016 without any explanation of delay. After investigation charge sheet was submitted under sections 147, 149, 341, 342, 504, 506 Indian Penal Code and differing with the same court took cognizance under section 307 of the Indian

Patna High Court Cr.Misc. No.75269 of 2018(2) dt.19-12-2018 2/3 Penal Code. The matter has also been compromised between the parties as is evident from annexure 2of the application. Considering the aforesaid submissions and the facts and circumstances of the case, prayer for bail to all the six petitioners is allowed. In the event of arrest/surrender within four weeks from today, let the petitioners as mentioned above be released on bail on furnishing bail bond of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of Sri Ashish Ranjan JM 1st class, Araria in Araria Bairgachhi Police Station Case No. 437 of 2017 on the following conditions:- One of the bailors will be a close relative of the petitioners who will give an affidavit giving genealogy as to how they are related with the petitioners. The bailor will also undertake to inform the Court if there is any change in the address of the petitioners and The Petitioners will be well represented on each date and if they fail to do so on two consecutive dates, their bail will be liable to be cancelled.
