The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 47(a) of the Excise Act.
800 litres of country made liquor were recovered from the house of the petitioner.
It is submitted by learned counsel for the petitioner that the recovery has been made from the joint family house and hence, it cannot be treated from the possession of the petitioner.
A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.
Patna High Court Cr.Misc. No.46331 of 2014 (02) dt.17-04-2015 2/2 Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Excise Case No. 78 of 2014 pending in the court of learned Chief Judicial Magistrate, Saran at Chapra.
