JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-07-2017 This appeal is for grant of bail in connection with Mirganj P.S. Case No. 97 of 2015 registered for the offence under section(s)366/366A/34/302 of the Indian Penal Code and section(s) 3 (i) (xi) of the SC/ST (POA) Act. After some argument, the learned counsel for the appellant has submitted that the appellant is minor and there is no allegation against the appellant and others. It has further been submitted that it is a case of honour killing and the informant himself killed his daughter.
Heard learned Special Public Prosecutor also. Having heard both sides and in view of the statement of the appellant that he is minor, I think that it will be appropriate to the appellant to move before the Juvenile Justice Board and
Patna High Court CR. APP (SJ) No.1468 of 2017 (2) dt.01-07-2017 2/2 make prayer for bail, which will be considered by the Juvenile Justice Board and after considering the submission as stated above and the materials available on record, the Juvenile Justice Board will pass an appropriate order.
With the above observation/direction, this appeal is disposed of.
