JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420,406,409 and 120B/34 of the Indian Penal Code.

The accusation is of purchase of solar light from a different agency other than BELTRON and BREDA and thereby misappropriation of Rs.18,50,500/- has been made. It is submitted by the learned counsel for the petitioner that the purchase was made in 2006 and 2008 whereas the direction for purchase from the aforesaid agencies was issued in 2010 and 2012. The petitioner was Panchayat Secretary of the alleged Panchayat for a brief period and the purchase was made by

Patna High Court Cr.Misc. No.46579 of 2014 (2) dt.17-04-2015 2/2 collective decision of the Panchayat members. Considering the delayed lodging of the FIR, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Buxar in connection with Simri P.S. Case No. 189 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
