The petitioner seeks bail in connection with Cheria Bariarpur P.S. Case No.58 of 2016 instituted for the offences under Sections 406, 409, 420, 504 and 506 of the Indian Penal Code.

As per allegation, the informant has given Rs.50,000/- with the assurance to pay Rs.1,00,000/- but the petitioner has neither given the enhanced amount nor the principal amount which led to filing of this case. The petitioner is in jail custody since 7.6.2016.

Having considered the facts and circumstances of the case, let the petitioner, namely, Ram Babu Paswan @ Rm Babu

Patna High Court Cr.Misc. No.39502 of 2016 (3) dt.22-09-2016 2/2 Paswan, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Manjhaul, Begusarai in connection with Cheria Bariarpur P.S. Case No.58 of 2016, subject to the conditions that (i) one of the bailors shall be a close relative of the petitioner i.e. father, mother, sister or son. (ii) If the petitioner is found involved in future in similar type of case the prosecution will be at liberty to make prayer for cancellation of his bail and the court below will pass necessary order including cancellation of bail and (iii) petitioner would participate in the court proceeding and in the event of being absent on two consecutive dates, the court below will be at liberty to cancel the bail bonds of the petitioner.

However, the trial court is directed to conclude the trial within a period of nine months. The petitioner is also directed to co-operate with the trial.
