The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 465, 467, 468, 474, 406, 471 and 420/34 of the Indian Penal Code. The complainant is sister of petitioner No. 1 Vijay Lakshmi Singh @ Vijay Lakshmi Devi. Petitioner No. 2 Gajendra Prasad Singh is husband of petitioner No. 1 Vijay Lakshmi Singh @ Vijay Lakshmi Devi. Allegation is that mother had executed a Will in favour of the complainant and the petitioners in collusion with others have created transfer deed in favour of some other person in respect of property of the complainant.

Patna High Court CR. MISC. No.20741 of 2019(2) dt.03-04-2019 2/2 Submission is that probate case brought by the complainant was dismissed after conversion into a title suit. Hence, the complainant has no claim.

Considering the entire facts aforesaid, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.20,000/- (rupees twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Ara Nawada Police Station Case No. 297 of 2010, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
