====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 14-10-2020 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State.

Petitioner is apprehending arrest in connection with Complaint Case No. 2568 of 2018 for the offence under sections 406 and 420 of the Indian Penal Code 20,20 N.D.P.S. Act.

Learned counsel for the petitioner submits that allegation against this petitioner is that Rs. 9 lacs was taken by the petitioner from the complainant for providing job of his sons.

Learned counsel submits that Rs. 2.27,000/- has been returned to the son-in-law and thereafter the present case has been filed. He further submits that in fact the complaint is concocted one as the petitioner is a retired employee of BSNL and he has no concern with the Health Department and as such there is absolutely no question of providing job in the Health

Considering the fact that the petitioner has no criminal antecedent and also the fact that the petitioner is a retired employee of BSNL and in a position to favour any one in the matter of appointment in health department, the Court is inclined to grant anticipatory bail to the petitioner subject to the condition that the petitioner shall deposit Rs. 1,00,000/- cash in the court below and on depositing of Rs. 1,00,000/- cash, the court below shall release the petitioner, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of communication of this order, on bail on furnishing bail bond of Rs. 1,00,000/- (One lac) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Saran at Chapra, in connection with Complaint Case No. 2568 of 2018 subject to the condition as laid down under section 438(2) of the Cr.P.C.

The amount of Rs. 1,00,000/- cash deposited by the petitioner shall abide by final outcome of the pending criminal case.
