JUSTICE ARUN KUMAR ORAL ORDER 21-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 379 and 411 of the Indian Penal Code. Allegation in brief is that this petitioner snatched a purse from co-passenger and jumped out from the bogy of the train and apprehended by the police. Immediately thereafter, he was chased and apprehended.

Learned counsel appearing on behalf of the petitioner submits that the allegation is false and fabricated. There is no recovery from his possession and he is suffering from mental disease and under treatment and has got no criminal antecedent and has been in jail custody since 11.10.2016.

No.54147 of 2016 (2) dt.21-12-2016 2/2 Considering the aforesaid facts and circumstances, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Sonepur, Saran in connection with Chapra Rail P.S. Case No.59 of 2016.
