====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 08-06-2017 Heard learned counsel for the petitioner and the State. Petitioner is apprehending his arrest in a case for the offences registered under Section 379 of the Indian Penal Code and Section 7 of the Essential Commodities Act. Allegation against the petitioner is that he was assisting co-accused Bijay Poddar in loading rice in the bags which was kept for Mid-Day-Meal in Madhya Vidyalaya, Itarari (Kanya).

It has been contended on behalf of the petitioner that he has got no criminal antecedent. He has falsely been implicated in the present case on account of village politics. It appears that no theft of rice was committed in the school. Nothing has been recovered from the possession of the petitioner. Petitioner will not

Considering the facts and circumstances of the present case, let petitioner, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Banka, in connection with Bandhua Kurawa P.S.
