The petitioner apprehends his arrest in Kashichak P.S. Case No. 90 of 2015 registered under Sections 493, 313, 376 of the Indian Penal Code.
The prayer for anticipatory bail of the petitioner was earlier rejected vide order dated 19.07.2016 passed in Cr. Misc. No. 20870/2016. Learned counsel for the petitioner submits that now the petitioner has already solemnized marriage with the victim and they are living together as husband and wife and a joint compromise petition has also been filed.
Be that as it may, I am not inclined to enlarge the petitioner on anticipatory bail in Kashichak P.S. Case No. 90 of
Patna High Court Cr.Misc. No.51892 of 2016 (2) dt.25-01-2017 2/2 2015. Accordingly, the same is rejected.
If the petitioner surrenders in the court below, the court below shall consider the prayer for regular bail of the petitioner on its own merit without being prejudiced from the order of this Court.
