Petitioner seeks bail in Majhaulia P.S. Case No.102 of 2019 registered under Section 379 of the IPC. The informant, in sum and substance, alleged that he parked his motorcycle bearing Registration no.BR22AB-4766 and kept his bag containing a Tab of the company and cash of Rs.25,000/-on the motorcycle in order to attend the call of nature but when he returned, he found his motorcycle and articles kept in a bag missing there.
Learned counsel for the petitioner submits that the petitioner is innocent and he has in fact committed no offence. The petitioner is not named in the F.I.R. The petitioner was apprehended on mere fact that the petitioner got criminal

It is further submitted that the petitioner was not put on T.I.P. and nothing has been recovered from possession of the petitioner. The petitioner is in jail since 20.12.2019. The petitioner has already remained in jail for about ten months. Having considered the facts that the petitioner has already remained in jail for about ten months, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Majhaulia P.S. Case No.102 of 2019.
