This application for anticipatory bail arises out of Kundwa (Chainpur) P.S. Case No. 198 of 2020 for the offence punishable under Sections 302 and 120-B/34 of the Indian Penal Code.

After some argument, learned counsel for the petitioner seeks permission to withdraw this bail application with a liberty to surrender in the Court below and seek regular bail.

If the petitioner surrenders in the Court below and seeks regular bail, the Court below shall consider and decide the same on its merit preferable on the same day without being prejudiced by the fact that he had moved before this Court for

Patna High Court CR. MISC. No.32856 of 2021(2) dt.09-02-2022 2/2 anticipatory bail and has withdrawn the same. The Court below will also consider the fact that similarly situated co-accused persons have been granted regular bail.

With the aforesaid observations and directions, this bail application is disposed of.
