2. The petitioner is apprehending arrest in connection with Gurua P.S. Case No. 262 of 2024 lodged on 13.08.2024, for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2018.

3. As per the prosecution, total recovery of 25 litres of illicit Mahua liquor has been made which is the subject matter of the present case.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that two accused persons were identified in the present case. From petitioner's possession 15 litres of illegal Mahua

Patna High Court CR. MISC. No.22014 of 2025(2) dt.02-05-2025 2/2 liquor was recovered and from the possession of co-accused 10 litres illegal Mahua was recovered. Counsel further submits that, as per allegation, the said illegal Mahua liquor was kept in the courtyard of the petitioner's house and due to this reason his name has transpired in the present case. Counsel further submits that criminal antecedent of the petitioner is clean and by some unknown enemy this activity has been done.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

As such, in the present facts and circumstances of this case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the Bharatiya Nagarik Suraksha Sanhita, 2023 to the satisfaction of Exclusive Special Excise Judge, Court No.5, Gaya, in connection with Gurua P.S. Case No. 262 of 2024, subject to the conditions as laid down U/s 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Dr. Anshuman, J) anand/- U T
