JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 20-04-2015 Heard learned counsel for the petitioner as well as learned A.P.P. for the State.

There happens to be allegation against the petitioner to have inflicted farsa blow over head of informant, Prem Lal Thakur. Apart from the fact that there happens to be specific disclosure regarding infliction of blow repeatedly, from the order impugned it is apparent that victim had sustained simple abrasion over head, that too simple in nature.

In the aforesaid background, petitioner should not apprehend that on his surrender before the learned lower court he will be taken into custody because of the fact that the learned lower court has to see and perceive the allegation in consonance with the injury report to arrive at right conclusion.
