JUSTICE ARVIND SRIVASTAVA ORAL ORDER 21-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is an accused in Complaint Case No.270 C/12 registered under Section 498 (A) of I.P.C. The accusation against the petitioner is of demand of dowry and on account of non-fulfillment of the dowry demand torturing the complaint (wife) by the petitioner and his family members.

The submission of the petitioner is that he is working as labour at Delhi with other accused but the complainant insisted her husband (petitioner) to sell his share of homestead land to gift her naihar which was strongly opposed by

Patna High Court Cr.Misc. No.53101 of 2016 (2) dt.21-12-2016 2/2 the petitioner upon which the complainant left her matrimonial house along with her children. Hence, the present false case has been filed.

Considering the facts and circumstances of the case, let the petitioner, abovenamed, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the S.D.J.M., Araria, in Complaint Case No.270 C of 2012.
