JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-01-2017 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor.

The application is for grant of bail in connection with Barh PS case no. 229 of 2015 for the offence under Sections 304B/34 of the Indian Penal Code.

It is submitted on behalf of petitioner that petitioner is the husband of deceased and he has been falsely implicated in this case, he has not killed the deceased rather deceased died due to cardiac arrest. It is further submitted that he is in custody for about one and half year.

Heard learned A.P.P. also. Learned A.P.P. has opposed the prayer for bail.

Having heard both sides. From perusal of the

Patna High Court Cr.Misc. No.47439 of 2016 (3) dt.18-01-2017 2/2 impugned order, it appears that in this case now charge has been framed and summons were issued to the witnesses. As such, I am not inclined to grant bail to the petitioner at this stage. Accordingly, his prayer for bail is rejected at this stage. However, petitioner may move for bail after examination of informant of the present case. As such, learned court below is directed to expedite the trial and directed to complete the examination of informant and other witnesses within six months.

With these observations, this bail application is disposed of.
