JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-12-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

This is an application for grant of regular bail for offences punishable under Section 406, 409 and 420 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that allegation against the petitioner that she defalcated an amount of Rs. 4,60,000/- as alleged but the same is not true as she retired on superannuation before the completion of construction of building as well as handpump and she is ready to pay the alleged amount with the condition of adjustment in final accounting if some time is granted to her.

Heard learned A.P.P. also.

Having heard both sides. It appears from the perusal of

Patna High Court Cr.Misc. No.55493 of 2016 (2) dt.23-12-2016 2/2 the petition that petitioner is a lady retired on superannuation and as such she is willing to pay the alleged amount of 4,60,000 within a period of six months, subject to final accounting, let the petitioner above named, be released on provisional bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. -1, Bikramganj, in connection with Kachhawan P.S. Case No. 12 of 2016, with the condition that she will deposit/pay the amount of Rs. 4,60,000/- within a period of six months from today. Thereafter, once the learned Court below is satisfied that the payment has been made by the petitioner to the concerned authority, shall confirm the provisional bail, granted to the petitioner.

With the observation as above, this application is, accordingly, disposed of.
