JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 31-08-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Nawada (Town) P.S. Case No. 724 of 2016 registered under Section 354 (B) of the Indian Penal Code.

The accusation is that Renu Kumari, the informant being a G.N.M. was on duty and in the night of 15/16-12-2016, the petitioner reached to the hospital and started misbehaving with her, but when she raised alarm, staff of the hospital came there and then the petitioner fled away with giving threatening to kill her. The informant further alleged that earlier her marriage was performed with the petitioner but his behavior was not good with her as he is un-social. Petitioner had also send her legal notice to

Patna High Court Cr.Misc. No.23486 of 2017 (4) dt.31-08-2017 which she had replied.

Learned counsel for the petitioner submits that informant is the wife of the petitioner and due to some petty dispute, the present case has been lodged. Petitioner has no criminal antecedent Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, Nawada in connection with Nawada (Town) P.S. Case No. 724 of 2016 subject to the condition as laid down under Section 438(2) of the Cr.P.C.
