JUSTICE SUDHIR SINGH ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 20-04-2015 The petitioner is a resident of Village-Punma Dharampur in Samastipur district. He has approached this Court complaining that the Mukhiya of his Panchayat has dismantled the building of the Panchayat and sold away the bricks.

The matter was taken up on 9th of March, 2015 and time was granted to the Block Development Officer, Samastipur, 6th respondent, to file a counter affidavit. Accordingly, a counter

Patna High Court CWJC No.14298 of 2014 (5) dt.20-04-2015 2/2 affidavit was filed and on perusal of the same, we expressed our dissatisfaction about the inaction on the part of the Block Development Officer.

It is reported that the District Magistrate has recommended the transfer of the Block Development Officer and an F.I.R. has been registered against the Mukhiya. We, therefore, close the writ petition by directing that further steps shall be taken in the matter by the concerned authority of the Department. The District Magistrate shall also ensure that the new building of the Panchayat is constructed at the earliest.
